El Foro de Políticas Públicas de la Provincia de Entre Ríos observa con gran preocupación algunos
hechos ocurridos que enrarecen el clima social en nuestra provincia y en todo el país. Se habla de acallar
a formadores de opinión por medio de una CONADEP para los trabajadores de prensa o de limitar la
opinión con la creación del NODIO. En estos días, observamos con preocupación la ocupación ilegal de
propiedades privadas por dirigentes vinculados directa o indirectamente con el poder político
provincial y nacional.
Tenemos conocimiento del gran déficit habitacional que existe en nuestro país como consecuencia de
políticas erráticas en materia de vivienda. Muchos ciudadanos no pueden acceder a una vivienda digna,
como sabiamente sostiene el artículo 14 bis de la Constitución Nacional. Pero esa circunstancia,
lamentable, dolorosa y triste, no habilita que se violente la propiedad privada. Mucho menos ofrecerles
a los “ocupa” o “necesitados” un subsidio temporario —de tres meses—que para nada va a resolver el
grave problema de viviendas. Es un parche, no una solución. Lo único que va a hacer es incentivar que se
ejecuten más acciones contrarias a derecho, que es lo que precisamente se debe combatir y erradicar
para defender en forma irrestricta la propiedad privada. Así lo establece expresamente el artículo 17 de
la Constitución: “La propiedad privada es inviolable y ningún habitante de la nación, puede ser privado
de ella, sino en virtud de sentencia, fundada en ley”.
No se debe combatir el delito mandando a delinquir. Esa no es la medicina. Lo que hay que hacer, y
que se ha obviado hace bastante tiempo, es generar políticas serias que permitan atender las
necesidades de ese gran sector social, limitados en servicios elementales para su vida. Así se evitará
que sean utilizados por quienes se aprovechan de su estado de necesidad. Esto atenta contra la
dignidad y la igualdad tan declamada y pocas veces ejercitada.
Como si todo lo expuesto no alcanzará para activar las antenas, también se intenta silenciar la libertad
de expresión de todas aquellas personas que pretendan emitir opiniones no deseadas por las
autoridades, tanto del poder político como del judicial. Esto es un intento liso y llano de conculcar un
derecho constitucionalmente reconocido – artículos 14 y 32–, como así también en la Convención
Americana sobre los Derechos Humanos, tratado internacional que adquiere raigambre constitucional al
ser incorporados por la reforma de 1994.
Si bien la libertad de expresión no es un derecho absoluto, cada uno puede ejercerlo libremente y, si
comete algún de delito o apología, debe responder por ello, previa condena fundada en la ley y con el
debido proceso. Lo que no corresponde es que se intente limitar a priori esa libertad. El artículo 19 de la
Declaración Universal de Derechos Humanos, lo reconoce como un derecho humano, como así también
en el Pacto Internacional de Derechos Civiles y Públicos, al decir “que todos tendrán derecho a opinar
sin interferencia” y “todos tendrán derecho a la libertad de expresión, esto incluirá la libertad de
buscar, recibir y difundir información e ideas de todo tipo, ya sea oralmente, por escrito o impreso, en
forma de arte o por cualquier otro medio de elección”, respetando por supuesto, la reputación o los
derechos de los demás, como así también el orden público y la seguridad nacional.-
La salud de nuestra provincia y de la república requiere de medidas que den seguridad jurídica, como así
también el respeto a los distintos poderes del estado argentino, a los fines de consolidar la paz social, en
una sociedad que se encuentra inmersa, en una gran crisis sanitaria, económica y moral, que hora tras
hora se acrecienta.
La democracia es el libre debate de ideas, la división de poderes y, 6fundamentalmente, la defensa plena
y sin titubeos de los derechos y obligaciones consagrados en nuestra Carta Magna. Son los poderes
constituidos los encargados de hacerla cumplir, respetándola. Caso contrario, ya sea por omisión o
inacción, serán responsables directos por lo que pudiere llegar a suceder, pues sembrar incertidumbre
continuamente al pueblo no sirve para nada y solo sirve, para acrecentar la desconfianza.
Es fundamental dejar de lado cuestiones ideológicas o partidarias en bien del interés superior, que sin
lugar a dudas lo constituye nuestra República.
