HISTÓRICA SESIÓN : El Senado convirtió en ley la Interrupción Voluntaria del Embarazo
Con 38 a favor, 29 en contra y una abstención, la Cámara Alta aprobó la iniciativa del Ejecutivo, que ya contaba con media sanción de Diputados.
El Senado aprobó hoy la ley de interrupción voluntaria del embarazo en una sesión histórica que empezó con un escenario muy parejo en la cantidad de votos y mucha expectativa puesta en el
Con 38 votos a favor, 29 en contra y una abstención del jujeño Guillermo Snopek (Frente de Todos), el proyecto enviado por el Gobierno al Congreso fue convertido en ley y con una mayoría más holgada que la que había logrado el “no” en el debate de 2018 (38 a 31).
En la definición de la puja entre “verdes” y “celestes” fueron determinantes la decisión de la neuquina Lucila Crexell (Interbloque Federal), los entrerrianos Stella Maris Olalla (Juntos por el Cambio) y Edgardo Kueider (Frente de Todos) y el salteño Sergio “Oso” Leavy (Frente de Todos) de votar a favor.
Los cuatro mantuvieron en suspenso su voto hasta el debate y su decisión fue determinante, junto con la ausencia sorpresiva de la riojana Clara Vega (Interbloque Federal), que había participado de la sesión y era considerada un voto en contra del proyecto, y el faltazo del puntano Adolfo Rodríguez Saá, otra baja para los “celestes”.
Crexell -que se había abstenido en el debate de 2018- resaltó: “¿Qué cambió desde 2018 cuando se rechazó el proyecto? Nada. Las mujeres siguen abortando en clandestinidad y soledad”.
“Los abortos no deberían existir, pero existen. Lo que falló fue la estrategia punitiva. Se condenaron mujeres injustamente.
Esta demostrado que la prohibición y la criminalización no disuade a las mujeres de los abortos”, afirmó la neuquina.
Olalla señaló que “mantener la prohibición no eliminará el aborto clandestino que efectivamente existe” y remarcó que se trata de un tema de “salud integral”, al tiempo que criticó que no se cumpla con la ley de educación sexual integral.
Leavy fundamentó su cambio de postura respecto de 2018, cuando votó en contra de la legalización del aborto siendo diputado nacional, al afirmar que aquel otro proyecto era “totalmente diferente”, aunque influyó la reunión que mantuvo días atrás con el presidente Alberto Fernández.
“Me he dado cuenta de que esta ley no obliga a abortar, no promueve el aborto, solo le da un marco legal seguro”, sostuvo el salteño y concluyó: “Si mi voto ayuda a que una mujer no pierda la vida, voto a favor”.
También influyó en el resultado que el Gobierno aceptara hacer en la reglamentación un cambio a la ley que había sido reclamado por Alberto Weretilneck (Juntos Somos Río Negro), cuya posición siempre fue a favor pero condicionó su voto.
Al inicio de la sesión la pamepana Norma Durango (Frente de Todos) anunció que se modificará una de las causales legales para practicar un aborto después de la semana 14 de gestación, referida al “riesgo integral” de la salud de la mujer y se eliminará la palabra “integral” en la reglamentación del Poder Ejecutivo.
La división que genera el tema al interior de cada bloque parlamentario llevó a que el tiempo reservado para los discursos de jefes de bloque se extendiera para que pudieran cerrar el debate un referente a favor y otro en contra por el Frente de Todos y por Juntos por el Cambio.
En ese contexto, la tucumana Silvia Elías de Pérez (Juntos por el Cambio) sostuvo que el proyecto “no pasa ningún test de constitucionalidad” y afirmó que “si se transforma en ley, lisa y llanamente significa que el Estado ha tirado la toalla”.
“Este proyecto no trae nuevas libertades ni nuevos derechos, trae negación del acceso a la vida”, agregó.
A su turno, el jefe del interbloque opositor, el formoseño Luis Naidenoff, calificó el tema del aborto como una “cuestión de Estado, no de creencias, fe o dogma”.
Tras señalar que pese a la penalización “se aborta en la Argentina a plena luz del día”, sentenció: “Esto se resolvió con el peso del dinero, que garantiza a las que lo tienen el acceso a la salud y la ausencia de consecuencias penales, y las que no tienen los recursos, tienen el peso de la clandestinidad y también el de la condena legal”.
“Si logramos que la interrupción voluntaria del embarazo vamos a demostrar que la dirigencia política es capaz de ponerse de acuerdo sin mezquindades y ponerse a la altura de las mayorías”, sostuvo la mendocina Anabel Fernández Sagasti (Frente de Todos).
La senadora destacó al movimiento de mujeres y afirmó que “no solamente es la revolución de las hijas, sino también de las madres, las abuelas, las sobrinas”, al tiempo que remarcó: “Las mujeres habremos conquistado el poder de decidir y quienes no están de acuerdo, nadie los va y las va a obligar a nada”.
Por último, el jefe del bloque Frente de Todos, José Mayans, ratificó su rechazo a la legalización del aborto al señalar que es “inconstitucional” porque choca con tratados internacionales suscriptos por la Argentina y lo comparó con “la pena de muerte”.
“Estamos de acuerdo con la autonomía y los derechos de la mujer, por supuesto, porque son nuestras madres, hermanas, hijas. Estamos de acuerdo siempre y cuando, como dice la Constitución no dañe a terceros. Se debe respetar los derechos de las niñas y niños por nacer”, afirmó el formoseño.
