Lo hizo a través de la Resolución 1373/2023 del Ministerio de Economía y la Resolución General 5418/2023 de la Administración Federal de Ingresos Públicos (AFIP), publicadas en el Boletín Oficial.
La medida, tendrá un tope de devolución de $ 18.800; y abarcará a trabajadores en relación de dependencia con ingresos de hasta seis Salarios Mínimos, Vitales y Móviles, y quienes perciban jubilaciones, pensiones por fallecimiento y pensiones no contributivas nacionales con un máximo de seis haberes mínimos.
De esta forma, el tope de ingresos para acceder al beneficio en el caso de los trabajadores será de $ 708.000 y de $ 524.758,56 para los jubilados.
También podrán acceder a la devolución del IVA el personal de casas particulares encuadradas en el régimen especial de la actividad, monotributistas de todas las categorías, y beneficiarios de la Tarjeta Alimentar o de las tarjetas emitidas del Programa Potenciar Trabajo.
Quedan exceptuados los contribuyentes del Impuesto a los Bienes Personales, siempre y cuando no paguen el tributo sólo por la tenencia de un inmueble para vivienda única, y los trabajadores autónomos.
Hasta hoy el reintegro –de sólo el 15% del IVA- regia únicamente para jubilados de hasta tres haberes mínimos (con tope de $ 18.000 mensuales) y beneficiarios de las asignaciones universales por hijo (AUH), por embarazo (AUE) y pensiones no contributivas, con techo, en estos tres últimos casos, de $ 4.056.
• Cómo acceder al beneficio
Para acceder al beneficio -que devolverá el 21% del IVA de estos productos- se deberá abonar con tarjeta de débito físicas de Pago Electrónico Inmediato (PEI) o a través de pagos con débito con códigos QR.
Luego de la transacción, el monto será reintegrado a la cuenta bancaria asociada a dicha tarjeta en un máximo de 48 horas: dentro de las 24 horas para las compras realizadas entre las 0:00 y las 17 del mismo día, y dentro de las 48 horas para las realizadas después de las 17 horas.
Una vez realizados los reintegros, estos aparecerán en los resúmenes de cuenta de cada mes con el identificador “Reintegro programa Compre sin IVA”.
Se podrá acceder al beneficio en los comercios registrados ante la AFIP bajo 25 nomencladores de actividades económicas, incluyendo mayoristas, hipermercados, supermercados, minimercados, fiambrerías, almacenes, dietéticas, carnicerías, pescaderías, verdulerías, mercados y puestos móviles; y comercios alimenticios especializados.
La iniciativa se extenderá hasta el 31 de diciembre próximo, aunque el Poder Ejecutivo elevará un proyecto de ley para reducir de forma permanente la carga tributaria que recae sobre los bienes de la canasta básica.
Para instrumentar el beneficio, la AFIP pondrá a disposición los datos de los beneficiarios (CUIT o CUIL) a las entidades que administran los sistemas de tarjetas de débito, en base a la información que suministre mensualmente –hasta el día 25 de cada mes- el propio organismo tributario y la Administración Nacional de la Seguridad Social (Anses).
