Catorce puntos complementarias para nuevo IFE
La ANSeS aprobó las normas aclaratorias para el control y otorgamiento del bono para trabajadores informales.
A través de la Resolución 202/2023, publicada este lunes en el Boletín Oficial, detalló los los requisitos que deben reunir las personas solicitantes para acceder a ese bono, que consiste en dos pagos mensuales de $47.000 cada uno, a realizarse en octubre y noviembre.
“Corresponde precisar ciertos aspectos a los efectos de lograr una correcta aplicación de las disposiciones contenidas en el decreto” que autorizó el pago de ese dinero, indicó la ANSeS.
Así, puntualizó que el trámite de solicitud para percibir el “refuerzo para trabajadores informales” constará de una “Inscripción, Solicitud y Validación de Datos” y podrá realizarse de manera remota desde la página Web de la ANSeS, mediante la utilización de la Clave de la Seguridad Social, o a través de las Oficinas y Operativos Móviles.
Para la percepción del bono, los requisitos son: tener entre 18 y 64 años, no tener ninguna prestación o asistencia del Estado ni trabajo formal, no haber sido alcanzado con otras medidas anunciadas, tener Clave de la Seguridad Social y una cuenta bancaria.
La persona tendrá que ser argentina o nativa, por opción o naturalizada, o extranjera (con fecha de residencia no inferior a dos años) debiendo habitar en el territorio argentino durante todo el período en el que cobrará el refuerzo.
Los jóvenes de entre 18 y 24 años de edad inclusive pueden acceder al cobro del refuerzo para trabajadores informales, cuando, además de cumplir con los requisitos, su grupo familiar no registre ingresos superiores a tres salarios mínimos.
Se entiende por grupo familiar de titulares de entre 18 y 24 años de edad inclusive, compuesto por el/los padre/s y/o la/s madre/s de la persona solicitante, cuando esta última no tuviera cónyuge o conviviente, ni hijas/os, ni adopciones, ni personas a cargo, ni guardas, ni curatela, ni tenencias, ni tutelas.
A los efectos de realizar el control de ingresos del grupo familiar, se considerará el criterio que se utiliza para la liquidación de las asignaciones familiares.
Se considerará la situación patrimonial de los padres y/o madres o de las personas de entre 18 y 24 años de edad inclusive, de acuerdo a lo informado por AFIP y la Comisión Nacional de Valores, en lo referente a la tenencia de plazos fijos, tenencia y operaciones como comprador y/o vendedor de bonos, acciones, compra de moneda extranjera, embarcaciones y declaración de bienes personales como automotores, inmuebles, aeronaves, embarcaciones.
La ANSeS también dispuso que quienes están excluidos del bono son aquellos que:
— Hayan realizado gastos y/o consumos con tarjetas de crédito por un importe mayor o igual a $120.000 entre junio y/o julio de este año.
— Hayan realizado gastos y/o consumos con tarjetas de débito y/o billeteras virtuales por un monto mayor o igual a $90.000 en los junio y/o julio de este año.
— Hayan efectuado una manifestación patrimonial en las declaraciones juradas del Impuesto sobre los Bienes Personales y/o tenencia de bienes informados por la Dirección Nacional de los Registros Nacionales de la Propiedad Automotor y de Créditos Prendarios y/o la tenencia de bienes informados por la Administración Nacional de Aviación Civil y/o la tenencia de embarcaciones.
— Sean titulares de automotor con menos de diez años de antigüedad.
— Sean titulares de aeronave o de una embarcación.
— Sean titulares o posean Plazos Fijos en junio y julio del corriente año.
— Sean titulares o posean Bonos y Acciones en febrero a julio de 2023.
— Hayan operado como compradores y/o vendedores de Bonos y Acciones en el exterior y/o mercado argentino en los últimos seis meses.
— Hayan realizado compra de moneda extranjera a través de cualquiera de los canales vigentes desde febrero de este año.
— Posean ingresos y/o acreditaciones bancarias y/o en billeteras virtuales mayor o igual a $90.000 en los meses de junio y julio.
— Sean titulares de bienes inmuebles, salvo que el mismo esté registrado en el Registro Nacional de Barrios Populares (RENABAP).
— No podrán acceder al refuerzo aquellas personas que tengan cobertura de salud a través de la medicina prepaga.
Según la Resolución, la ANSeS enviará la información necesaria a la AFIP, a la Dirección Nacional del Registro de la Propiedad Automotor (DNRPA), a la Comisión Nacional de Valores (CNV) y a la Superintendencia de Seguros de Salud, a los efectos de realizar la evaluación socioeconómica de los solicitantes.
Por otra parte, el refuerzo para informales se abonará a través de una transferencia bancaria en la cuenta de la persona solicitante quien deberá informar la Clave Única Bancaria (CBU).
El resultado de las evaluaciones realizadas y la determinación del derecho a percibir el refuerzo, estará disponible en el sitio Mi ANSeS, dentro del Aplicativo Digital “Refuerzo para Trabajadores Informales”.
1. Solicitud
El trámite de solicitud para percibir el REFUERZO PARA TRABAJADORES INFORMALES constará de una “Inscripción, Solicitud y Validación de Datos” y podrá realizarse de manera remota desde la página WEB de esta ADMINISTRACIÓN NACIONAL DE LA SEGURIDAD SOCIAL (ANSES) (www.anses.gob.ar), mediante la utilización de la Clave de la Seguridad Social, o a través de las Oficinas y Operativos Móviles, mediante el formulario y los procedimientos que oportunamente establecerá esta Administración.
El Aplicativo Digital “REFUERZO PARA TRABAJADORES INFORMALES” será el medio por el cual la ciudadanía podrá realizar el trámite de “Inscripción, Solicitud y Validación de Datos” del REFUERZO PARA TRABAJADORES INFORMALES, aprobado por el Decreto Nº 493/23. La SUBDIRECCIÓN EJECUTIVA DE ADMINISTRACION establecerá las fechas límites para poder realizar la solicitud del REFUERZO PARA TRABAJADORES INFORMALES y los requerimientos de la ciudadanía que guarden relación con el mismo, en base a los análisis técnicos y operativos que realice para tal fin.
2. Trabajadores Informales
Para la percepción del REFUERZO PARA TRABAJADORES INFORMALES, se considerarán a todas aquellas personas que reúnan los requisitos establecidos en el Decreto N° 493/23 y superen la evaluación socioeconómica que se establece en el Punto 6 del presente Anexo.
3. Residencia y Edad
a. A los efectos de lo establecido en el inciso a) del artículo 3° del Decreto N° 493/22, la persona debió haber habitado en el territorio de la REPÚBLICA ARGENTINA durante el período citado en el artículo mencionado, y deberá permanecer en el mismo durante la vigencia de la prestación. Para acreditar lo dispuesto en el párrafo precedente, esta ADMINISTRACIÓN NACIONAL DE LA SEGURIDAD SOCIAL (ANSES) realizará los intercambios de información correspondientes con la DIRECCIÓN NACIONAL DE MIGRACIONES, por los medios que a tales fines establezcan.
b. A los efectos de lo establecido en los incisos a) y b) del artículo 3º del Decreto N° 493/23, la fecha a considerar será el 30 de septiembre de 2023, inclusive.
4. Jóvenes de entre 18 y 24 años
En el caso de las personas mencionadas en el artículo 4º del Decreto N° 493/23 de entre DIECIOCHO (18) y VEINTICUATRO (24) años de edad inclusive, las mismas podrán acceder al cobro del REFUERZO PARA TRABAJADORES INFORMALES cuando, además de cumplir con los requisitos, su grupo familiar no registre ingresos en los términos establecidos en el Punto 5 del presente Anexo.
5. Grupo Familiar
Entiéndese por grupo familiar de titulares de entre DIECIOCHO (18) y VEINTICUATRO (24) años de edad inclusive, conforme lo establecido en el artículo 4º del Decreto Nº 493/23, al compuesto por el/los padre/s y/o la/s madre/s de la persona solicitante, cuando esta última no tuviera cónyuge o conviviente, ni hijas/os, ni adopciones, ni personas a cargo, ni guardas, ni curatela, ni tenencias, ni tutelas.
Los datos de la totalidad de los integrantes del grupo familiar deben encontrarse actualizados en las bases de datos de esta ADMINISTRACIÓN NACIONAL DE LA SEGURIDAD SOCIAL (ANSES), conforme la normativa vigente que rige a tales efectos.
A los efectos de realizar el control de ingresos del grupo familiar, se considerará el criterio que se utiliza para la liquidación de las asignaciones familiares.
Se considerará la situación patrimonial de los padres y/o madres o de las personas de entre DIECIOCHO (18) y VEINTICUATRO (24) años de edad inclusive, de acuerdo a lo informado por AFIP y la Comisión Nacional de Valores, en lo referente a la tenencia de plazos fijos, tenencia y operaciones como comprador y/o vendedor de bonos, acciones, compra de moneda extranjera, embarcaciones y declaración de bienes personales como automotores, inmuebles, aeronaves, embarcaciones.
Para poder acceder al cobro del REFUERZO PARA TRABAJADORES INFORMALES, la conformación del grupo familiar, de manera conjunta, no deberá verificar ingresos mensuales superiores al valor equivalente de TRES (3) Salarios Mínimos Vitales y Móviles.
6. Evaluación socioeconómica
Determinase que no se considerarán destinatarias del REFUERZO PARA TRABAJADORES INFORMALES a aquellas personas solicitantes que:
a. Hayan realizado gastos y/o consumos con tarjetas de crédito por un importe mayor o igual a PESOS CIENTO VEINTE MIL ($120.000) entre los meses de junio y/o julio del corriente año;
b. Hayan realizado gastos y/o consumos con tarjetas de débito y/o billeteras virtuales por un monto mayor o igual a PESOS NOVENTA MIL ($90.000) en los meses de junio y/o julio del corriente año;
c. Hayan efectuado una manifestación patrimonial en las declaraciones juradas del Impuesto sobre los Bienes Personales y/o la tenencia de bienes informados por la Dirección Nacional de los Registros Nacionales de la Propiedad Automotor y de Créditos Prendarios y/o la tenencia de bienes informados por la Administración Nacional de Aviación Civil, y/o la tenencia de embarcaciones;
d. Sean titulares de automotor con menos de DIEZ (10) años de antigüedad;
e. Sean titulares de aeronave;
f. Sean titulares de embarcación;
g. Sean titulares o posean Plazos Fijos en los meses de junio y julio del corriente año;
h. Sean titulares o posean Bonos y Acciones en los meses de febrero a julio del corriente año;
i. Hayan operado como compradores y/o vendedores de Bonos y Acciones en el exterior y/o mercado argentino en los últimos SEIS (6) meses;
j. Hayan realizado compra de moneda extranjera a través de cualquiera de los canales vigentes desde febrero del corriente año;
k. Posean ingresos y/o acreditaciones bancarias y/o en billeteras virtuales mayor o igual a PESOS NOVENTA MIL ($90.000) en los meses de junio y/o julio del corriente año;
l. Sean titulares de bienes inmuebles, salvo que el mismo esté registrado en el Registro Nacional de Barrios Populares (RENABAP).
7. Cobertura de Salud
En relación a lo establecido por el punto v) del inciso e) del artículo 3º del Decreto 493/23, no podrán acceder al REFUERZO PARA TRABAJADORES INFORMALES aquellas personas que tengan cobertura de salud a través de la medicina prepaga.
8. Intercambios de información
Esta ADMINISTRACIÓN NACIONAL DE LA SEGURIDAD SOCIAL (ANSES) enviará la información necesaria a la ADMINISTRACIÓN FEDERAL DE INGRESOS PÚBLICOS (AFIP), a la DIRECCIÓN NACIONAL DEL REGISTRO DE PROPIEDAD AUTOMOTOR (DNRPA), a la COMISIÓN NACIONAL DE VALORES, a la SUPERINTENDENCIA DE SEGUROS DE SALUD, a los efectos de realizar la evaluación socioeconómica de las personas solicitantes del REFUERZO PARA TRABAJADORES INFORMALES.
9. Determinación de derecho
Producida la inscripción, esta ADMINISTRACIÓN NACIONAL DE LA SEGURIDAD SOCIAL (ANSES) realizará, previo a la liquidación y pago, la revisión de los requisitos establecidos en la normativa vigente, con la información disponible en las Bases de Datos que administra; la que se obtenga de los intercambios de información y aquella que haya recibido oportunamente para la tramitación de otras prestaciones y/o servicios de otros Organismos, al momento de efectuar los análisis correspondientes.
10. Notificación a las personas solicitantes
Esta ADMINISTRACIÓN NACIONAL DE LA SEGURIDAD SOCIAL (ANSES), por los medios que arbitre, notificará a la persona solicitante si reúne la totalidad de los requisitos exigidos para percibir el REFUERZO PARA TRABAJADORES INFORMALES, en virtud de los resultados de la evaluación efectuada, informando, en caso de denegatoria, la circunstancia de exclusión comprobada.
11. Otorgamiento y pago
El REFUERZO PARA TRABAJADORES INFORMALES se abonará a través de una transferencia bancaria en la cuenta de la persona solicitante, quien deberá informar a esta ADMINISTRACIÓN NACIONAL DE LA SEGURIDAD SOCIAL (ANSES) la correspondiente Clave Única Bancaria (CBU).
En aquellos casos en que la persona solicitante registre algún medio de pago vigente en las bases de esta ADMINISTRACIÓN NACIONAL DE LA SEGURIDAD SOCIAL (ANSES), el REFUERZO PARA TRABAJADORES INFORMALES se abonará en el medio de pago ya registrado, siempre que la persona haya prestado conformidad.
12. Resultados
El resultado de las evaluaciones realizadas y la determinación del derecho a percibir el REFUERZO PARA TRABAJADORES INFORMALES estará disponible en el sitio MI ANSES, dentro del Aplicativo Digital “REFUERZO PARA TRABAJADORES INFORMALES”.
13. Liquidación, control y pago
Concluidas las revisiones y evaluaciones establecidas en los puntos precedentes, se procederá a la liquidación, control y puesta al pago de la prestación monetaria, de conformidad con lo que establece la normativa vigente, dando cumplimiento a los procesos de reglas de derecho y pautas vigentes al momento de la liquidación, y según el cronograma que oportunamente comunicará esta ADMINISTRACIÓN NACIONAL DE LA SEGURIDAD SOCIAL (ANSES).
14. Prestación no pasible de descuento
El REFUERZO PARA TRABAJADORES INFORMALES no será susceptible de descuento alguno, ni computable para ningún otro concepto.
