En la misma jornada, el Juez de Garantías dictó la prisión preventiva domiciliaria por el término de 21 días, que deberá cumplirlos en otro domicilio en el que fue detenido.

Legarreta comentó este miércoles que la investigación “se encamina a pensar en que desde el plexo probatorio, con las evidencias procesadas que se van incorporando ya sea de testimonios, cámaras, mi defendido fue sujeto a una situación de violencia previa, a punta de machete y con amenazas”.

Según agregó, “en el Derecho Penal, en el marco de lo que nosotros trabajamos con la teoría del delito, siempre que hay una conducta típica prevista por el Código Penal y hay que pensar si esa conducta típica encuadra en las figuras de la anti-juricidad que es el próximo estadio de análisis penal”.

En ese contexto teórico, el abogado puntualizó, “la legítima defensa es una figura de la anti-juricidad penal, es decir, hay algunas determinadas circunstancias donde el derecho permite que una persona pueda llegar a lesionar a otra”.

Vale aclarar, continuó, “hay distintas variantes, la más común es cuando se está sufriendo una agresión ilegítima y es inminente – como en este caso- y encima hay riesgo de vida”. Incluso, mencionó el profesional, “podría pensarse también en el estado emocional de esa persona, en el tiempo en que sucedieron los hechos y – sin adelantar pero tampoco negar la participación de mi defendido – en esas circunstancias consideramos que, a prima facie, podría haber actuado en una situación permitida por el derecho o de legítima defensa”.

En ese contexto, Legarreta comentó que el comerciante “está actualmente en un domicilio, con unas medidas cautelares por un lapso de 21 días”, imputado “por homicidio simple”.

Por lo tanto, adelantó, “estaremos dialogando en los próximos días, en las próximas semanas, para saber cuál es el criterio que va a tomar principalmente el Ministerio Público Fiscal en relación a la causa; decidiendo la suerte del proceso en un sentido de si esto va a ser remitido a juicio, si la propia fiscalía desde su objetividad considera que hay legítima defensa y si persiste la acusación o si vamos a terminar en un debate oral y público”.

Por último, y consultado acerca de si la cantidad de disparos efectuados puede tomarse como un agravante para la situación procesal de su defendido, Legarreta aclaró que así “no lo ha interpretado la Fiscalía, por lo tanto yo tampoco veo un agravante aplicable”.

Por tanto, argumentó, “está imputado por un homicidio simple y no hay ninguna figura agravante que se le haya adjudicado”.

Como corolario, el abogado confirmó que “por lo que he visto en las actuaciones del Registro Nacional de Reincidencia, (Ramón “Berugo” Miranda) tenía antecedentes penales computables pero no podría precisar si es una o dos condenas”.
